1. Purchase and delivery of products
You must be over 18 years of age to purchase products from our site.
Business customers accepting these Terms hereby confirm that they have the authority
to bind any business on whose behalf you use our site to purchase Products.
All products on our site are subject to availability.
After placing an order, you will receive an automatic response from us to confirm the products, colors and quantities you have ordered.
Please note that this does not mean that we accept your order.
We will confirm stock availability and therefore acceptance of your order (Confirmation) in a second email
where we will also detail delivery arrangements such as courier tracking information and estimated delivery times.
The contract between Us and You will be concluded when We send this confirmation correspondence.
If we are unable to supply you with the product you require for any reason,
we will inform you of this by email or telephone and will not process your order.
We reserve the right to offer you alternative, like-for-like products in the same color and sheen.
Any such proposed change to your order will be communicated to you by email or telephone
and you will be able to accept or decline our offer of an alternative.
If you refuse, we will refund the full amount paid as soon as possible.

Please note that different services, charges and delivery times apply for deliveries to addresses in the Republic of Bulgaria
for certain postcodes as set out on our delivery information page at the time of your purchase.
Delivery times are approximate only.
We cannot be held responsible for any delays in your delivery once we have dispatched your order to our courier service.
If you are a professional decorator or have booked a decorator to complete a project,
we recommend that you place your paint order at least 7 working days before the project start date.
We are not responsible for delayed delivery. We reserve the right to deliver some shipments by cash on delivery.
Our courier partners require a signature upon delivery.
You can request a courier service to leave your package in a secure location
by completing the 'delivery instructions' field on the checkout page or by mentioning this to a member of staff when making a request over the phone.
Benjamin Moore Bulgaria is not responsible for damaged, missing or lost parcels when you have requested that your shipment be left without a signature.
If you choose to have your goods sent to a forwarder or a third party forwarder,
we will declare your order fulfilled and complete when it is scanned by our designated forwarder upon leaving our premises.
We do not consider such third party supply arrangements to be secure
as we cannot verify their handling of the goods and will therefore not accept any liability for loss or damage arising out of such arrangements.
We will notify you by email when your orders are ready for collection.
All orders not claimed within 3 months will be destroyed and custom made products will not be eligible for refunds.
2. Products
Benjamin Moore is a respected manufacturer with a strong reputation for reliable and consistent production.
However, product defects may occasionally occur. A statement about our defective item policy forms part of these terms.
It is your responsibility to review all information in our Technical Data Sheets and Material Safety Data Sheets
and to ensure that you and all employees and/or contractors at all times comply with and carry out the advice contained therein,
including any recommendations for storage, application, site conditions, surface preparation and disposal.
All technical information given on our website or in response to any inquiry is provided by Benjamin Moore Bulgaria in good faith and for guidance only,
as application skills and site conditions are beyond our control.
Ultimately, it is your responsibility to ensure that you select the correct product for your particular situation and site conditions.
Benjamin Moore offers warranties on specific products.
Our Warranty Statement forms part of these Terms and supersedes any previously published Warranty Statements.
Benjamin Moore Bulgaria shall not be liable for the performance or non-performance of any goods beyond the value of such goods
(such as loss of time, costs incurred by any person, costs of additional equipment or any alleged consequential losses of any is a person).
We shall not be liable in respect of any additional costs, lost profits, consequential,
financial or any other losses beyond the invoice price, less any discounts, of the goods which are the subject of the complaint.
Colors
Benjamin Moore has made every effort to represent our colors as accurately as digital and print media allow.
You should also review our Color Accuracy Statement which forms part of these terms.
Please note that our product color swatch is only intended to indicate the color of the product
and does not represent the product you ultimately purchase in terms of gloss and/or product performance.
Return and cancellation

Price
The price of our products is listed on our website including VAT at the prevailing rate.
We reserve the right to change our prices from time to time,
but such price changes will not apply to orders that we have confirmed by confirmation email.
We reserve the right to refuse to accept any order where there is a material error in the description of the goods or in the advertised price.
We quote our prices inclusive of VAT at the current rate applicable in the Republic of Bulgaria
The price of our products does not include shipping. Our current shipping rates are detailed in our Shipping Information section.
3. Payment
Payment of both selected products and applicable shipping charges is in advance.
All goods remain the property of Benjamin Moore Bulgaria until all amounts due are received.
You are not entitled to withhold payment of the price of the goods due to a claim against us.
The granting of any credit is at the absolute discretion of Benjamin Moore Bulgaria.
Your payment, by debit or credit card or free bank transfer,
is entered into a payment page managed and controlled by Benjamin Moore Bulgaria.
Your payment details are not visible or provided to us as part of this process.
We can also take orders and payments over the phone.
In this case, your payment details will be processed in the same way and will not be saved by us.
4. Force majeure circumstances
If we are prevented from making any delivery of goods subject to a contract between us,
at all or within the expected delivery time due to circumstances not due to Benjamin Moore Bulgaria's willful default,
any such delivery may be canceled or suspended by giving you written or email notice.
In such circumstances we shall not be liable for any loss, damage or expense arising from such non-delivery or delayed delivery.
Such circumstances include without limitation industrial action, civil unrest, invasion, terrorist attack
or threat thereof, war (whether declared or not) or threat of preparation for war, fire, explosion, storm, flood, earthquake,
collapse, epidemic or other natural disaster, damage to public or private telecommunications networks
or impossibility to use rail, ship, plane, motor transport or other means of public transport.
5. General
Your purchase of products from us will be a contract entered into in Bulgaria under Bulgarian law
and any dispute arising under or in connection with the foregoing will be subject to the exclusive jurisdiction of the Bulgarian courts.
The above exclusions and limitations do not affect (and are subject to) your statutory rights as a user, which cannot be excluded by law.
For example, liability for fraud or injury/damage caused by our negligence cannot be excluded.
Each of the paragraphs of these Terms operates separately.
If any court or competent authority decides that any of them is illegal or unenforceable, the remaining paragraphs will remain in full force and effect.
